End User License Agreement

This End User License Agreement (this "Agreement") is a binding legal agreement between you and ServeBot LLC ("ServeBot," "we," "us," or "our") governing your access to and use of the Shadow Cricket mobile application, including any updates, patches, bug fixes, and related documentation (collectively, the "App").

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT DOWNLOAD, INSTALL, ACCESS, OR USE THE APP.

1. License Grant

Subject to your compliance with this Agreement, ServeBot grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a compatible device that you own or control, solely for your personal, non-commercial entertainment use.

The App is licensed, not sold, to you.

2. Ownership and Intellectual Property

The App, including all software, code, gameplay systems, designs, graphics, interfaces, audiovisual content, text, trademarks, service marks, trade names, logos, and all associated intellectual property rights, is owned by or licensed to ServeBot and is protected by applicable intellectual property and other laws.

Except for the limited license expressly granted under this Agreement, no right, title, or interest in or to the App is granted to you.

3. Eligibility

You may use the App only if you have the legal capacity to enter into this Agreement, or if you are using the App under the supervision of a parent or legal guardian who agrees to be bound by this Agreement on your behalf.

4. App Functionality and Online Play

Shadow Cricket is a motion-based cricket game that uses your device camera and on-device pose detection to allow you to simulate batting shots in real life. All camera and pose-detection processing occurs strictly locally on your device and is not transmitted over the internet.

The App currently features both offline and online modes. App functionality includes:

  • viewing a tutorial and playing offline matches;
  • playing online multiplayer matches, including private rooms with friends and random matchmaking;
  • the automatic creation of a "Guest Account" using a backend database (such as Supabase) to remotely store basic information like your chosen nickname, handedness selection, match history, and gameplay stats.

Accessing online multiplayer features and saving Guest Account data requires an active and stable internet connection. ServeBot may modify, suspend, or discontinue any feature of the App—including online servers and matchmaking functionality—at any time, with or without notice, to the maximum extent permitted by law.

5. Device Permissions

The App requires access to your device camera in order to provide core gameplay features. If you do not grant required permissions, some or all features of the App will not function.

You are responsible for ensuring that you have the necessary rights and permissions to use the device on which the App is installed.

6. Safety Warning and Assumption of Risk

The App requires physical movement. You acknowledge and agree that use of the App may involve risks associated with bodily movement, swinging motions, loss of balance, collisions, falls, and contact with nearby people, animals, furniture, walls, or objects.

You agree that you will:

  • use the App only in a safe and appropriate environment;
  • maintain awareness of your surroundings at all times;
  • ensure adequate free space before playing;
  • stop immediately if you feel discomfort, dizziness, pain, fatigue, or any other physical issue.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU ASSUME ALL RISKS ARISING FROM YOUR PHYSICAL USE OF THE APP.

7. Restrictions

You shall not, and shall not permit or assist any third party to:

  • copy, reproduce, distribute, publicly display, or publicly perform the App except as expressly permitted by this Agreement or applicable law;
  • modify, adapt, translate, or create derivative works of the App;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive source code, trade secrets, or underlying ideas from the App, except to the extent such restriction is prohibited by applicable law;
  • remove, alter, or obscure any copyright, trademark, or proprietary notices;
  • use the App for any unlawful, fraudulent, or abusive purpose;
  • interfere with, disrupt, damage, or compromise the App, its matchmaking servers, backend databases, or any related systems;
  • use cheats, bots, lag switches, automation, exploits, or unauthorized modifications, particularly those designed to give an unfair advantage in online multiplayer modes.

8. Advertisements

The App may contain advertisements, including rewarded advertisements. By using the App, you acknowledge that certain gameplay features, rewards, or progression elements may be associated with the viewing of advertisements.

ServeBot is not responsible for the content, availability, legality, or accuracy of third-party advertisements, products, or services.

9. Privacy

Your use of the App is also governed by the Shadow Cricket Privacy Policy, which is incorporated into this Agreement by reference. The Privacy Policy details how your Guest Account data is handled and stored.

10. Updates and Changes

ServeBot may, but is not obligated to, provide updates, upgrades, patches, fixes, or new versions of the App. Such updates may be installed automatically or may require manual action by you, depending on your device or platform.

Future versions of the App may add additional live services, cloud storage features, traditional account login methods, or new multiplayer systems. If that occurs, additional or updated terms may apply.

11. Third-Party Services and Platforms

The App relies on third-party platforms, operating systems, stores, software libraries, SDKs, backend database providers (e.g., Supabase), and advertising providers. Those third parties may impose their own terms, conditions, and privacy policies, and ServeBot is not responsible for third-party services except as required by law.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS," WITHOUT WARRANTY OF ANY KIND.

SERVEBOT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, SERVEBOT DOES NOT WARRANT THAT:

  • THE APP (INCLUDING ONLINE MULTIPLAYER SERVERS) WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE;
  • THE APP WILL ALWAYS FUNCTION ON ANY PARTICULAR DEVICE;
  • DEFECTS WILL BE CORRECTED;
  • THE APP WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERVEBOT OR ITS AFFILIATES, MANAGERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE APP OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, SERVEBOT SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING OUT OF OR RELATING TO YOUR PHYSICAL USE OF THE APP, EXCEPT TO THE EXTENT SUCH LIMITATION IS PROHIBITED BY APPLICABLE LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVEBOT'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP OR THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID, IF ANY, TO LICENSE THE APP; OR (B) USD $10.00.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless ServeBot and its affiliates, managers, members, officers, employees, contractors, licensors, and service providers from and against any claims, actions, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your use or misuse of the App;
  • your violation of this Agreement;
  • your violation of any applicable law or regulation;
  • your infringement or violation of any rights of any third party.

15. Term and Termination

This Agreement begins when you first download, install, access, or use the App and continues until terminated.

ServeBot may terminate or suspend this Agreement or your license to use the App (including restricting your access to online multiplayer features) at any time if you fail to comply with this Agreement.

Upon termination, the license granted to you shall immediately cease, and you must stop using the App and delete all copies of the App from your device.

16. Export and Sanctions Compliance

You represent and warrant that you are not located in, under the control of, or a national or resident of any country or territory subject to applicable trade restrictions, and that you are not listed on any applicable government restricted party list, to the extent such laws apply to the distribution or use of the App.

17. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of Wyoming, without regard to its conflict of laws rules, except to the extent consumer protection laws in your jurisdiction require otherwise.

Any dispute arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Wyoming, unless applicable law provides otherwise.

18. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

19. Entire Agreement

This Agreement constitutes the entire agreement between you and ServeBot regarding the App and supersedes all prior or contemporaneous understandings, communications, and proposals relating to the App, except where additional platform-specific terms apply.
